What are EB-1A-NIW

They are two paths to permanent residence where you file your own petition, without an employer sponsoring you. What you must prove differs for each one.

EB-1A (extraordinary ability).

For professionals with an outstanding track record in their field. You must meet at least 3 of 10 achievement criteria and pass an overall evaluation of your career.

NIW (exención por interés nacional).

Requires an advanced degree or exceptional ability. It assesses whether your work has national importance, whether you are well positioned to advance it, and whether it benefits the U.S. to waive the job offer.

There is no “better” path. The right one depends on your profile and is defined in the consultation.

Who it is for

It is worth evaluating your case if:

  • You have a university or graduate degree and solid experience in your field.
  • You have published, won awards or been in the media for your work.
  • You have led teams, projects or companies with measurable impact.
  • You have been a judge, reviewer or evaluator of other professionals’ work.
  • Your work is valuable in a field of interest to the U.S., such as technology, health, engineering, research or business.

You don’t have to meet every point. Your achievements count wherever you earned them.
