How the T Visa can change your situation
- T Visa
- Humanitarian Visas
The T Visa exists for a very specific reason: to protect people who have been victims of human trafficking, whether labor or sex trafficking, and to give them an immigration path that does not depend on whoever exploited them. If you have lived through this situation or know someone who has, here we explain in general terms what it is about.
What is the T Visa?
It is an immigration status (T Nonimmigrant Status) designed for victims of severe human trafficking. It is requested from USCIS with Form I-914.
Who might qualify, in general terms?
According to USCIS guidelines, a person is generally considered potentially eligible if they:
- Were or are a victim of a severe form of human trafficking (labor or sex trafficking, as defined by federal law).
- Are physically in the United States (or at a port of entry) as a result of that trafficking.
- Have complied with reasonable requests from the authorities, unless they were a minor when the trafficking occurred, or are unable to cooperate due to physical or psychological trauma.
- Would suffer extreme hardship involving unusual and severe harm if removed from the country.
- Are admissible, or may qualify for a waiver of certain grounds of inadmissibility.
What benefits can it bring?
In general terms, this status may include:
- An initial stay of up to 4 years, with the possibility of an extension in some cases.
- Work authorization.
- Access to certain federal and state benefits.
- A possible path to permanent residency (green card).
- The possibility for certain family members to apply as derivatives as well.
This is neither a guarantee nor legal advice
Each of these points depends heavily on the specific case, the evidence available, the type of trafficking, the immigration history, and more. This information is general and is not a substitute for a real evaluation of your situation.
